农副产品销售合同模板 篇1

乙方：

根据《^经济合同法》及相关法律法规和甲乙双单位的有关规定，遵循平等、自愿、公平公正、诚实信用的原则，经采购事项签订如下协议：

一、产品名称、规格、单价、数量、金额

二、质量要求技术标准：砂石料严格按照gb/t14684—20x标准组织供货，不合格材料拒收。如因质量不合格，乙方收料人有权拒收，其不合格材料由甲方立即运出乙方现场，造成的损失由甲方承担。

三、交货地点和时间：以乙方电话通知的时间为准，在乙方料场交货(乙方必须提前一天电话通知甲方，甲方接到通知后必须在次日完成货物配备)。

四、运输方式及费用负担：由甲方负责承运，乙方承担费用负担。

五、验收方法及标准：以工地现场实际过磅(方量)为准雨季材料受雨水影响含水率较高，到场数量根据实际情况进行验收按第二条约定的国标验收，数量异议在货到3日内并保持原包装的情况下由乙方书面提出，质量异议在货到5日由乙方书面提出。因质量问题不符合约定，甲方应无条件的退货或按乙方要求换货。

六、结算付款方式及期限：以甲方开据的发货单为凭证结算，每月20日对账，次月15日按月支付80%，每半年度结至半年所供材料的95%，尾款每年度结清，甲方不开据货物和运输发票。

七、违约责任：甲乙双方自本合同签定之日起，自觉履行本合同，违约方将负责承担影响工程进度的一切费用和责任。

八、解决合同纠纷的方式：协商解决，协商不成，可提请有关职能部门进行调解，如调解不成向签约地人民法院提起诉讼。

九、其他约定事项

1、甲方在运输过程中必须严密遮盖防止泼洒对环境造成污染，甲方运送车辆驾乘人员进入施工现场应佩戴安全帽，甲方在乙方工地范围外运输过程中涉及环保、道路维护、交通及运输安全、城管及外部干扰等问题由甲方自行处理。

2、其他未尽事宜，甲乙双方另行协商。

3、本合同经甲乙双方签字盖章后生效。有效期自签定之日起至乙方竣工货款付清为止。

4、本合同一式二份，甲乙双方各执一份。

5、当市场价格发生变动，上、下涨(跌)幅达到5%时，需进行价格调整，双方确定的新价格以补充合同的形式进行签定。
